Terms & Conditions for Protection Plans
EQUIPMENT COVERED Protection Plans covers only residential natural gas furnaces or residential electric central air conditioning units. Equipment serving more than one dwelling unit is not eligible for coverage. The following parts are excluded from coverage under all inclusive plans: heat exchanger, air conditioning compressor, air conditioning condenser coil and refrigerant leaks. The following are excluded under all plans: furnace filters, and parts added on to accommodate ancillary equipment such air purifiers, humidifiers, etc. Replacement of the complete heating unit or complete air conditioning unit is not covered under any of these plans.
UNAVAILABLE PARTS and PART REPLACEMENT If a part is unavailable, we will attempt to obtain a replacement part or an equivalent substitute as quickly as possible, but limited availability of certain parts may result in delays from time to time. In particular, but without limitation, we may not be able to readily or locally obtain parts. In the unusual event that we cannot provide a part replacement or an equivalent substitute, we will not be liable for such part replacement, equivalent substitute or for any resulting damages. Parts replacement or equivalent substitutes are solely at our discretion. Any part that is found to be defective and is replaced under your plan coverage becomes our sole property and may be disposed of at our discretion.
LIMIT ON LIABILITY We are not the manufacturer or supplier of the heating unit or the cooling unit and we make no representations, warranties or conditions as to the performance of either unit. We will not be liable for any loss, damage or injury of any type arising out of or related to your coverage or plan or caused or contributed in any way by the use and operation of the heating unit and/or the cooling unit, any indirect, incidental, special or consequential damages, even if reasonably foreseeable. If we are not able to perform any of our obligations under this Agreement because of circumstances or events beyond our control, we shall be excused from the performance of such obligations for the duration of such circumstances or events and we shall not be liable to you for such failure to perform. These plans do not cover any losses, repairs or replacements on account of the following: design faults or pre-existing faults/defects/deficiencies or which have previously been repaired during the first 30 days prior to the date of commencement of the plan, improper use, tampering, alterations or repairs by persons other than personnel of ACD, loss, fire, theft, accidental or deliberate damage, extreme weather conditions, subsidence, structural repairs, redecoration or renovation related work, explosion, earthquake, lightning, flood, storm, acts of war, act of God or other insurable risks, improper setting of the thermostat, the household electrical fuse or circuit breaker required for the unit is blown or other electrical problems, improper sizing or application of the equipment, the Heating or Cooling Unit has been turned off, plumbing or drain system issues, wilful damage, adequacy or capacity of systems, lack of reasonable maintenance (which includes the replacement of filters which is the homeowner’s responsibility), duct work issues or cosmetic damage or defects, You will indemnify us from all claims, losses and costs that we may suffer or pay, or may be required to pay, including legal expenses, in connection with the heating unit and/or the cooling unit this Agreement or the use and operation of either unit, including any claims against us for any injury or death to individuals or damage to property. You will pay, when due, all taxes and other charges imposed by any governmental authority on or in connection with this Agreement or your payments made under it.
OTHER TERMS We will not reimburse you for the costs of services or parts replacement performed by contractors that have not been authorized by us. Except as specifically noted in this Agreement, your plan coverage is non-refundable. Your plan coverage is not transferable to another residence but is transferable to a new homeowner where the plan is being presently provided. We have the right to change, from time to time, any term of this Agreement by sending you prior notice of the change and such change will be effective 30 days after the date set out in that notice. We may sell, assign or otherwise dispose of, or grant a security interest in, all or part of our right and interest in this Agreement to anyone else, without notice to you or your consent. To the extent not prohibited by law, you will not assert against any transferee any claims, defences, set-offs, deductions or counter-claims which you may now or in the future be entitled to assert against us.
AFD (AC & Furnace Depot) reserves the right to reject coverage of any unit for a Plan, under any and all circumstances, including if an inspection by our service technician finds that the equipment is in substandard condition. In that case, the equipment must be brought up to industry standards at the customer's expense at the time of the first maintenance check before the Plan will be accepted. AFD shall not be responsible for system design failures or installation failures by the owner or third parties.
All routine service must be performed during normal working hours (Monday - Friday, 7:00 AM -7:00 PM). All maintenance checks will be scheduled during normal working hours.
AFD will do our best to deliver speedy service, but service calls will be performed based on availability and AFD is not liable for losses as a result of delays. If 3rd parties perform services under a unit covered by an AFD plan, it will immediately terminate the plan and any AFD obligations under the plan. No plan refunds or other credits will be given by AFD under these circumstances.
AFD has the discretion to determine whether to repair or replace defective material and parts. In the event any or all of the equipment is not, in our opinion, economically repairable, AFD will quote the replacement cost. Until replacement has taken place; no further service will be performed.
For any plans provided by ACD for free, customer agrees to the occasional receipt of emails from us or our affiliates. Cancelling the receipt of emails will immediately terminate the plan being offered. ACD has the right to cancel any plan for any reason and is only responsible for the below.
All plans, with the exception of plans that are provided for free, have a term of 12 months and are renewed automatically for an additional 12 month term unless at least 30 days written notice of cancellation is provided by the customer prior to the end of the 1 year term. No auto renewal if that is indicated on the invoice. Depending on the promotion being offered, payments are to be made either monthly or full payment of the 12 month contract to be made at the start of the plan. No refunds for early termination by either party. Although we may attempt to remind you from time to time of any maintenance to which you may be entitled, we are not obligated to do so and you are responsible for contacting us to arrange any such annual check-up or cleaning at a mutually convenient time. We will not be responsible for any annual check-up or cleaning that is not provided due to you failing to contact us and any preventative maintenance or other services not scheduled and performed prior to the end of the contract are forfeited. Free plans are renewed automatically but can be cancelled at any time by either party without penalty.
During the execution of the work covered under the plan, there may be minor damages to the wall-coverings, drywall, plaster, wall paper, paint, floor coverings, tile, cabinetry, counter tops, landscaping or there may be structural or cosmetic defects. Costs of redecoration or restoration of these damages/defects are not covered under any plans.
If there is any Building and Zoning Code Requirements or violations which are discovered before or during the diagnosis or repair of Equipment, you are required to complete the necessary corrective work at your own expense, before we take up the required repair or services of the equipment. You are required to obtain the necessary permits before we take up the service or repair of the equipment. We shall not be responsible for service or repairs, or delay in rendering the service on account of your noncompliance of any of the above requirements. If additional costs are incurred in order to comply with local, provincial, or federal law, we shall not be responsible for that additional expense.
